Overwinnnig tegen Mabeco en Tata Steel.

Dani heeft zijn zaak tegen Mabeco en Tata Steel gewonnen!

Wij zijn blij om te kunnen meedelen dat Daniel’s arbeidsconflict tegen Mabeco en Tata Steel, wegens zijn arbeidsongeval, tot een goed einde is gekomen.

Zoals eerder vermeld heeft Dani een ernstig arbeidsongeval gehad tijdens zijn werk bij Tata Steel.

Dit arbeidsongeval werd aanvankelijk door het bedrijf ontkend en in de doofpot gestopt, maar later toch toe gegeven. Je kunt niet een werknemer aansprakelijk stellen en hem zonder enige financiële of medische steun ontslaan met als argument dat de werknemer als freelancer (zzp-er) werkt. Dit is gebaseerd op een valse zzp constructie. Daniel werkte immers in werkelijkheid volgens vaste schema’s en volgde de instructies net zoals de andere werknemers in loondienst.

Nadat Daniel een operatie had ondergaan, en de revalidatie periode met succes had doorstaan en fysiek begon te herstellen van het pijn, besloot hij dat hij niet zou toestaan dat Tata Steel of Mabeco zijn lichaam verminken uit hebzucht van het bedrijf.

Met de steun van Vloerwerk, is hij een campagne gestart om zichtbaarheid te geven en de vinger te wijzen naar de bedrijven die verantwoordelijk zijn voor deze daad van werkgeversterrorisme, waar Daniel zelf de organisator van zijn campagne was.
Samen hebben wij zijn toespraken uitgewerkt voor op de dag van het piket. En samen hebben wij met Vloerwerk kameraden alle oproepen georganiseerd, de uitwerking van spandoeken en de verspreiding via social media gedaan.

De campagne concentreerde zich op de plekken die bij Tata steel het de meeste pijn doen: het publieke imago.

Dit werd weerspiegeld door de media die beelden uitzonden van de acties en pickets die werden uitgevoerd tijdens het door Tata Steel gesponsorde schaaktoernooi dat in januari plaatsvond. De heilige koe van de Nederlandse arbeidsveiligheid werd ontmaskerd; Tata Steel biedt concessies aan bedrijven, zoals Mabeco, die zich niet aan de veiligheidsvoorschriften houden en dubieuze arbeidsconstructies gebruiken.

Tijdens deze pickets werden buren en pers ingelicht over de zaak, werden flyers uitgedeeld en werd er veel lawaai gemaakt, waardoor de vreedzame avond die Tata Steel had georganiseerd voor de internationale schaakwereld, haar sponsors en ’s werelds beste schaakspelers, werd verstoord.

Mabeco en Treffer uitzendbureau werden ook het doelwit van de campagne met acties om de zaak aan de kaak te stellen op hun sociale netwerken en na een actie van telefoontjes naar hun kantoren met als doel hun parasitaire activiteit te verlammen waarbij ze zich toeleggen op het vinden van kwetsbare werknemers zodat ze de vruchten van hun arbeid kunnen stelen via “per dienst” commissies.

Na deze reeks pickets en acties heeft Daniel uiteindelijk 100% van zijn eisen ingewilligd. Deze waren:

Volledige compensatie voor maanden ziekteverlof.
Medische dekking.
Steun tot hij een andere baan vindt.

Het winnen van deze campagne is een grote overwinning voor alle arbeiders die zich, zelfs als zzp-er, afvragen of hun arbeidsrechten via dit soort rare constructies niet volledig verloren is gegaan. Het antwoord op de misbruik door de werkgevers en deze valse constructies is dit: strijd, pickets en confrontatie in alle ruimten.

Dani has won his case against Mabeco and Tata Steel!

We are pleased to announce that Daniel’s labor dispute against Mabeco and Tata Steel, due to his work accident, has come to a successful conclusion.

As previously mentioned (https://vloerwerk.org/2021/12/biceps-tendon-ripped-off-at-work-own-responsability-vloerwerk-demands-compensation-truth-from-tata-steel-contracter/), Dani suffered a serious work accident while working at Tata Steel.

This work accident was initially denied and covered up by the company, but later admitted. You cannot hold a worker liable and fire him without any financial or medical support on the grounds that the worker is working as a freelancer (zzp-er). This is based on a false zzp construction. In fact, Daniel actually worked according to fixed schedules and followed instructions just like other salaried employees.

After Daniel underwent surgery, and successfully passed the rehabilitation period and began to recover physically from the pain, he decided that he would not allow Tata Steel or Mabeco to mutilate his body out of corporate greed.

With the support of Flooring, he launched a campaign to give visibility and point the finger at the companies responsible for this act of employer terrorism, where Daniel himself was the organizer of his campaign.
Together we worked out his speeches for the day of the picket. And together with Floorwork comrades, we organized all the calls, elaborated banners and distributed them through social media.

The campaign focused on the places that hurt the most at Tata steel: the public image.

This was reflected by the media broadcasting images of the actions and pickets carried out during the Tata Steel sponsored chess tournament that took place in January. The sacred cow of Dutch labor safety was exposed; Tata Steel offers concessions to companies, such as Mabeco, that do not adhere to safety regulations and use dubious labor constructions.

During these pickets, neighbors and press were informed about the case, flyers were handed out and a lot of noise was made, disrupting the peaceful evening Tata Steel had organized for the international chess world, its sponsors and the world’s best chess players.

Mabeco and Treffer employment agency were also targeted with actions to denounce the case on their social networks and after an action of phone calls to their offices with the aim of crippling their parasitic activity in which they focus on finding vulnerable workers so they can steal the fruits of their labor through “per service” commissions.

After this series of pickets and actions, Daniel finally met 100% of his demands. These were:

Full compensation for months of sick leave.
Medical coverage.
Support until he finds another job.

Winning this campaign is a great victory for all workers who, even as self-employed workers, wonder if their labor rights have not been completely lost through these kinds of strange constructions. The answer to the abuse by the employers and these false constructions is this: struggle, pickets and confrontation in all spaces.
